The Freedom of Information (Jersey) Law 2011 provides public access to information held by scheduled public authorities (SPA), identical or similar requests from the same individual do not have to be complied with.

Under the Freedom of Information (Jersey) Law, 2011 members of the public can request information held by a scheduled public authority (SPA).

Under Article 21(1) of the Freedom of Information (Jersey) Law, 2011, scheduled public authorities (SPAs) don’t have to comply with vexatious requests. There is no public interest test.

In this guidance, we’ll look at whether information is being held by a scheduled public authority (SPA) for the purposes of the Freedom of Information (Jersey) Law, 2011.

A scheduled public authority (SPA) has two basic obligations under the Freedom of Information (Jersey) Law, 2011:

• To inform an applicant that information is not held (Art.10(1)), or
• To supply the person with information (Art.8(b)).

The Freedom of Information (Jersey) Law, 2011 applies to official information held in private email accounts (and other media formats) when held on behalf of a Scheduled Public Authority.
